California Congressman Eric Swalwell is constitutionally ineligible to run for Governor of California. In sworn mortgage documents, Swalwell declared his Washington, D.C. home as his “principal residence.” He has no California residence. As a result, he fails to meet the California Constitution’s requirement that a gubernatorial candidate must reside in California for five years immediately preceding the election. Swalwell also submitted materially false candidate filings, under penalty of perjury, by listing his Sacramento attorney’s office address as his home address.

I have filed a Petition for Writ of Mandate against California Secretary of State Shirley Weber to compel her to perform her ministerial, non-discretionary duty to enforce the constitutional and statutory qualifications for Governor. Under the California Constitution and Elections Code 349, the Secretary of State must decline certification of Eric Swalwell, a declared candidate who is constitutionally ineligible.
